From then until the time of her death, Miss Mutz lived here and was well known, having many relative and a host of friends in this vicinity. PETER ANDREAS MUTZ (From the correspondent in St. Nazianz, 18 Feb.) Death last Tuesday, 12 February, of Peter A. Mutz at age 67 following a long illness. For 27 years he was Rector of the local congregation and was successor to Father Ambros Oschwald, founder of the colony and the congregation… The funeral was held Saturday conducted by 12 Priests and an enormous crowd. Regrettably, the Archbishop was delayed at the last minute and was unable to attend and deliver his speech. It was the largest number of people ever to have attended a funeral in St. Nazianz. Mr. L. Kassenhagen of Chicago, a nephew of the deceased, was here to attend his uncle’s funeral. Der Nord Westen, 21 Feb. 1907 ******** Notes From St. Nazianz. Last Thursday, Feb. 14, Rev. Father P. A. Mutz died of pneumonia at his home here. The deceased was born Dec. 15, 1840, at Wuertenburg, Germany, and was ordained as priest of the Catholic church on the 18th day of Dec., 1869. He had charge of the St. Gregory’s congregation for 27 years, and during his stay in our midst had won many, many friends, who with sorrow look upon his early demise. His funeral, which took place Saturday, Feb. 16, was the largest ever held here, which fact goes to show that he was well known and highly respected by all who knew him. During the past few years the decedent had lived a retired life and because of his suffering from an ailment affecting his lower limbs. The immediate cause of his death was, as stated above, pneumonia. He was about sixty-seven years old at the time he was summoned from earth. Rev. Father Mutz’s long and faithful service here has stamped his benign influence indelibly upon this community. He was a kind-hearted, approachable man who numbered among the legions of his friends all good men, irrespective of creed or denomination, who had the pleasure of his acquaintance. He was a man among men—a kind friend, a wise counselor, a helpful neighbor, a spiritual leader to his congregation and a tireless Christian worker. May he rest in peace! Our midst his kindly face has left; His friendly voice is hushed on earth; Our people all now are bereft Of his advice they fain have heard. But while his life on earth has ended And his dust has to dust returned, His soul has to the blest ascended To live the life his faith hath earned. So let us not bemoan his loss, But profit by his Christian life; And we shall give less thought to dross, While onward, onward we do strive. Manitowoc Pilot, February 21, 1907 ******** PRIEST FAILED TO KEEP PROMISE Charge is Basis of a Contest Raised on Will of St. Nazianz Priest $2850 IS CLAIM FILED Heirs of Former Housekeeper Of Dead priest-Demand Payment For Her Services-Estate??? Large One Charging that Rev. Peter Andrew Mutz, deceased, of St. Nazianz, neglected to fulfill a promise made ten years ago, of bequeathing a share of his estate to Elizabeth Burger in return for her services as housekeeper, heirs of the woman, who is also dead, have filed a claim against the estate and a contest is being waged in probate court, the hearing having been started today. John Burger, a brother, and administrator of the estate of Elizabeth Burger, representing the interest of two sisters in addition to his own, files the contest and demands the sum of $2850, less $475 which is allowed for payments made in the sum of $5 monthly at various time previous to the death of his sister. Claim is also made to one lot in St. Nazianz which it is alleged was included in the promise given by Rev. Mutz ten years ago. Oral agreement, alleged to have been made by Rev. Father Mutz, who was formerly in charge of the church of the Divine Savior at St. Nazianz is the basis of the action which has tied up the $20,000 estate of the deceased priest. According to the complaint Mrs. Burger entered the services of Rev. Mutz as housekeeper in April 1896 and continued up to the time of her death in 1904. It is claimed that she was promised a legacy of $2600 cash and title to lot 7 in St. Nazianz in payment for her services. It is alleged that a will carrying out this provision was prepared by Rev. Mutz and exhibited to friends but when the document, purporting to be the last testament of the priest, who died Feb. 12, 1907, was filed, the name of Mrs. Burger or her heirs was not mentioned. In the claim filed against the estate a charge is made for services of Mrs. Burger from April 1896 to March 1905 ninety-five months at a rate of $30 monthly, totaling $2850. From this is deducted $475 for monies paid, leaving a balance of $2375 which is demanded, together with the real estate, one lot. In the complaint it is claiming that Rev. Mutz was ill during most of the time and that Mrs. Burger was required to perform services as nurse and housekeeper. The will, which bears the date of August 12, 1905, four months after the death of Mrs. Burger, dispose of an estate of between $15,000 and $20,000 to relatives of the priest and to various church and charitable institutions the relatives receiving sums of from $400 to $2000 each and the church of Divine Savior at St. Nazianz $2000, St. Gregory's congregation St. Nazianz $2000. It is provided that in event of death of any of the beneficiaries under the will, the bequest shall be distributed in twelve shares to church societies, including the Capuchin monastry, Mt. Calvary, Holy Family convent, Alverno and others. A peculiarity of the will and which it is contended indicates a probable belief of the testator that a contest might be raised, is a provision that Rev. Deibele, who is named as executor, is given authority to compromise and settle any contest against the estate. Hustings & Hustings, of Fond du Lac, represents the contestants. FINDS RECEIPT.
Rev. Deible of St. Nazianz, administrator of the estate of the late Rev. Mutz, recently found a paper in a book in the library of the deceased priest which purports to a receipt of $163 and a settlement in full for all claims of John Burger, Mrs. Rosa Gosslin and Mrs. Theresa John, heirs of Elizabeth Burger. The receipt is dated March 1904, shortly after Miss Burger's death. Miss Burger was housekeeper for Father Mutz for many years and her heirs brought an action against the administrator of the Mutz estate to recover for wages which they claimed was due their dead sister. They lost the case in probate court but took an appeal to the circuit court. They won out in circuit court last January, securing a verdict for $1400, but the sum was cut down considerably as a part of the claim was outlawed.
On Friday last Rev. Deible filed an affidavit in probate court as to the finding of the receipt. As a result of this Judge Chloupek issued an order to be served on Burke & Craite, attorneys for the Burgers, ordering them to appear before Judge Kirwan on May 25 to show cause why the verdict secured in circuit court should not be set aside and a new trial granted. The hearing was postponed until Wednesday. E.G. Nash is attorney for the estate.
The hearing in the matter Wednesday was again postponed until Saturday as the attorneys were not prepared to argue the case.
