CARUS, FRED CIRCUIT COURT NTOES. The criminal calendar was set for yesterday. W.R. Kimball again occupies the reporter's desk. Promptness and punctuality do not seem to be characteristics of Manitowoc attorneys. W.J. Turner, now of Milwaukee, came down to attend to his numerous cases in court here. Court opened on Tuesday, June 6th, Judge N.S. Gilson, presiding. His honor keeps up his habit of promptness and hard work. Joshua Stark, one of Milwaukee's veteran lawyers, came down as attorney for the defense in the case of Julia E. Hartung vs. Concordia Fire Ins. Co. J. Wahlaeger, Secretary of the Concordia Fire Ins. Co., of Milwaukee was in court, being interested in some of the cases. John Robinson, of Kossuth, made his appearance in the court room on Thursday and shook hands with his honor, the judge. The jurors have a fine time, when not on duty, lounging in the court house park, which Sheriff Murphy keeps in excellent condition. Henry Levenhagen and Dennis Shanahan are the accommodating attendants, and they make the jurors feel at home. It was found necessary to order a special venire of eight men, and the following names were retained as such jurors: Hm. Martins, John Comer, Mich. Ripplinger, Hugh Gillet, Wm. Bach, J.P. CHASE, THOMAS F. NOTICE OF FORECLOSURE. TO ALL whom it may concern: Whereas, On the 10th day of March 1857, Robert E. Rickaby, of Manitowoc county, and State of Wisconson, as mortgager, executed and delivered to Thomas F. Chase, as mortgagee, a certain mortgage bearing date on that day, to secure the payment by the said mortgagor to the said mortgagee, of the sum of Two Hundred Eighty Five Dollars on the nineteenth day of March, 1862, with interest from the date at the rate of seven per cent, per annum, according to the conditions of a certain Promissory Note bearing even date therewith, executed by the said Robert E. Rickaby the said mortgagor, to the said Chase, mortguagee, which said mortgage was duly executed and acknowledged so as to be entitled to record, and was recorded in the office of the Register of Deeds of the county of Manitowoc aforesaid on the 20th day of March, 1857, at 9 1/2 o'clock A.M., in volume II of Mortgages, at pages 116, 117, and 118, and Whereas, On the 15th day of May, 1862, the mortgagee aforesaid duly assigned the said mortgage for a valuable consideration to Benjamin Smith ?d by a written instrument of assignment bearing date on that day, which assignment was duly executed and acknowledged so as to be entitled to record, and was duly recorded in the office of the Register of Deeds, aforesaid on the 23d day of July, A.D. 1862, at 3 o'clock P.M. and recorded in volume M of Mortgages at pages 216, 217 and Whereas, By the terms of said mortgage, the said mortgagee, his heirs, executors, administrators or assigns were authorized and empowered to grant, bargain, sell, release and convey the premises therein described, in case of the non-payment of the sum of money and interest secured to be paid thereby or any part therof, or in case of the nonpayment of the taxes therein agreed to be paid within the time limited for that purpose, and Whereas, The said mortgager covenanted and agreed in and by the said mortgage to pay the sum of Ten Dollars and Solicitor's Fees in case of the foreclosure of the same by reason of the non perfomance of any of the conditions thereof, and Whereas, Default has occurred in the conditions of said mortgage by the non-payment of the said note and interest aforesaid, amounting to the sum of $391.40, which sum the said Assignee now claims to be justly due thereon, and Whereas, The said Assignee is now the lawful owner and holder of the said note and mortgage, and Whereas, No action or proceeding has been instituted to recover the debt now remaining secured by said mortgage or any part thereof; Now, therefore, Notice is hereby given that in pursuance of the power of sale contained in said mortgage, and of the Statute in such case made and provided, the said mortgage will be foreclosed by a sale of the premises therein described or so much thereof as may be necessary to be sold to satisfy the amount due on the said mortgage with interest and the costs and expenses of sale, together with the sum of Ten Dollars as Solicitor's Fees, agreed in said mortgage to be paid in case of the foreclosure thereof and all taxes which the said Assignee shall have paid on said premises prior to the day of such sale, at Public Vendue, by Wyman Murphy, the Sheriff of said county of Manitowoc, at the Court House in the village of Manitowoc in said county, on the 19th day of Septmeber, 1862, at ten o'clock in the forenoon, to the highest bidder.
