SMITH, UNKNOWN IN: Notes from Mishicott. The uncertainty regarding the disposal of the Smith Estate has at last been settle. It was sold at Sheriff's Sale, at Manitowoc, last Saturday, March 17. From the time of opening the sale, to its close, it was evident that those who bid for the estate, considered it a very desirable piece of property. Everybody was intensely interested in the progress of the sale. About a dozen people from this village were among the bidders. The property was sold to Nic Terens and I. Craite jointly, their bid being $1805. Thus we are now able to state with absolute certainty that the Smith Estate is open for sale, by lots or otherwirse (sic), by Nic Terens and I. Craite, who are able to give clear deeds and title to each and every purchaser. The newly purchased property includes, unsold lots in block 8; a tract of about 28 acres; Cemetery lots; unsold lots in block C; 1/2 interest in the water power, the other half being owned by the Two Rivers Manufacturing co. Briefly, the property lies between Rockway and Jackson Str. north of East Water Str. and east of Jackson Str. along the river. Some of these lots have already been sold. STAUET, MATH. CIRCUIT COURT NOTES. The criminal calendar was set for yesterday. W.R. Kimball again occupies the reporter's desk. Promptness and punctuality do not seem to be characteristics of Manitowoc attorneys. W.J. Turner, now of Milwaukee, came down to attend to his numerous cases in court here. Court opened on Tuesday, June 6th, Judge N.S. Gilson, presiding. His honor keeps up his habit of promptness and hard work. Joshua Stark, one of Milwaukee's veteran lawyers, came down as attorney for the defense in the case of Julia E. Hartung vs. Concordia Fire Ins. Co. J. Wahlaeger, Secretary of the Concordia Fire Ins. Co., of Milwaukee was in court, being interested in some of the cases. John Robinson, of Kossuth, made his appearance in the court room on Thursday and shook hands with his honor, the judge. The jurors have a fine time, when not on duty, lounging in the court house park, which Sheriff Murphy keeps in excellent condition. Henry Levenhagen and Dennis Shanahan are the accommodating attendants, and they make the jurors feel at home. It was found necessary to order a special venire of eight men, and the following names were retained as such jurors: Hm. Martins, John Comer, Mich. Ripplinger, Hugh Gillet, Wm. Bach, J.P. STOLL, ANTON CIRCUIT COURT NTOES. The criminal calendar was set for yesterday. W.R. Kimball again occupies the reporter's desk. Promptness and punctuality do not seem to be characteristics of Manitowoc attorneys. W.J. Turner, now of Milwaukee, came down to attend to his numerous cases in court here. Court opened on Tuesday, June 6th, Judge N.S. Gilson, presiding. His honor keeps up his habit of promptness and hard work. Joshua Stark, one of Milwaukee's veteran lawyers, came down as attorney for the defense in the case of Julia E. Hartung vs. Concordia Fire Ins. Co. J. Wahlaeger, Secretary of the Concordia Fire Ins. Co., of Milwaukee was in court, being interested in some of the cases. John Robinson, of Kossuth, made his appearance in the court room on Thursday and shook hands with his honor, the judge. The jurors have a fine time, when not on duty, lounging in the court house park, which Sheriff Murphy keeps in excellent condition. Henry Levenhagen and Dennis Shanahan are the accommodating attendants, and they make the jurors feel at home. It was found necessary to order a special venire of eight men, and the following names were retained as such jurors: Hm. Martins, John Comer, Mich. Ripplinger, Hugh Gillet, Wm. Bach, J.P. Wickert, Wm. Groll, John Bolen. The following cases have been disposed of up to date: The board of supervisors of Brown Co., vs. John Shoemaker and Chr. Schwarts. SVACINA, FRANK MAY REMAIN IN JAIL FOR MONTHS. Frank Svacina Appeals Case But Has Secured no Bond. Regardless of the fact that he pleaded guilty in Municipal court, Frank Svacina has filed a notice of appeal to Circuit court in the case in which he was sentenced to thirty days in jail for an assault on his wife. As a result of the action Svacina may remain in jail several months instead of thirty days, this being the case in event he fails to secure a bond which now seems probable. Since filing the appeal Svacina has made an effort to get bonds, but as yet has met with no success. Should failure continue, he will be forced to remain in prison until the court meets in January for the hearing of the appeal. The matter is causing him considerable worry. Svacina is proprietor of the Kewaunee house and it is reported that in the asaualt on his wife he was given much the worst of it, the woman defending herself with a stove poker. Todl, the administrator of said estate, setting forth the amount of personal estate that has come to his hands, and the disposition thereof,-the amount of debts outstanding against said deceased, and a description of all the real estate of which said deceased died seized, and the condition and value of the respective portions thereof, and the names of the heirs of said deceased, designating those that are minors; and praying that license be to him granted to sell all of the real estate of said deceased, to wit: The east half of the north west quarter of section number twenty-one, township number twenty, range number twenty-two, east, containing eighty acres of land more or less according to government survey, all of said lands lying and being in the county of Manitowoc and State of Wisconsin: that a portion of said real estate, to-wit: The south half of the east half of the north west quarter of section number twenty-one, township number twenty, range number twenty-two, east, constituted the homestead of said deceased, and that the whole of said real estate was at the time of the death of said deceased, and now is, subject to two mortgages, the first to secure the sum of five hundred dollars, and the second in the some of Fifteen hundred dollars given as security for a bond of maintenance, by deceased to his fahter John Svacina, and his mother Annie Svacina, both of whom are now living, that both of said mortgages were given for the purchase price of said real estate, and it appearing by said petition, that there is not sufficient personal estate in the hands of said administrator to pay said debts, mortgage indebtedness, and expenses of administration, and that the value of the real estate not included in said homestead, togehter with such personal estate would be insufficient therefor, and that the two parts of said real estate could not be sold separately without great injury to the interests of the parties, and that it is necessary in order to pay said debts, mortgage indebtedness, and expenses of administration, to sell the whole of said real estate; it is therefore ordered that all persons interested in said estate appear before this court, on Tuesday, the second day of May, A.D., 1882, at ten o'clock A.M., at the Probate Office in the city of Manitowoc, in said county, then and there to show cause (if any there be) why license should not be granted to said administrator to sell said real estate according to the prayer of said petition. SWOBODA, RUDOLPH IN COURT AGAIN Arraigned to municipal court upon a charge of desertion and non-support of his wife and child, Rudolph Swoboda was given another chance by Judge Schmidt and was placed on probation for a term of two years after he had furnished a bond of $500 to comply with conditions imposed by the court. Swoboda must pay $6 a week for the support of his wife and child, the money to be turned over to t he sheriff as trustee under orders of the court. Swoboda must report to the sheriff each week.
